Sudun is committed to maintaining high availability and performance standards in accordance with our Service Level Agreements (SLAs). For customers who qualify for a service plan, the SLA forms an integral part of these Terms.
Service charges are based on the plan and usage you choose. Unless otherwise stated, all prices are in U.S. dollars. We reserve the right to modify pricing with 30 days' notice.
Payment shall be made on time according to the billing cycle selected at the time of purchase. Failure to pay may result in suspension or termination of the Service.
Eligibility for refund is determined based on the specific service plan and actual situation. For refund requests, please contact our support team.
The services provided by Sudun, including all software, documentation, trademarks, and content, are owned by Sudun, Jindun, or used under license and are protected by intellectual property laws.
You retain ownership of all content transmitted through the Services. By using the Services, you grant SUDUN a limited license to cache, transmit, and process your content solely for the purpose of providing the Services.
We process personal data in accordance with the Privacy Policy and applicable data protection laws, including the applicable General Data Protection Regulation. You are responsible for ensuring that your use of the Services complies with all applicable data protection requirements.
To the fullest extent permitted by law, Sudun shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services, or for any loss of profits, revenue, data, or business opportunities.
Our aggregate liability for any claim arising out of these Terms shall not exceed the amount paid by you to Sudun in the twelve (12) months prior to the claim.
You agree to indemnify, defend, and hold harmless Sudun and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
We may modify these Terms at any time by posting a revised version on our website. Material changes will be notified via email or through the Services. Your continued use of the Services following such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sudun is registered, without regard to its conflict of law principles. Any dispute arising out of these Terms shall be resolved by binding arbitration or in a court of competent jurisdiction.
These Terms, together with the Privacy Policy, Acceptable Use Policy, and Service Level Agreement, constitute the entire agreement between you and Sudun with respect to the Services.
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
Sudun's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
